Kathy’s Drapes by Design – Terms of Trade (2026 Compliant)

These Terms apply to all quotes, orders, products, and services supplied by Kathy’s Drapes by Design Limited (“we”, “us”, “our”). By accepting a quote, paying a deposit, or placing an order, you (“you”, “the customer”) agree to these Terms.

1. Overview

These Terms replace all previous agreements. They are written in clear, plain language to meet the requirements of:

  • the Fair Trading Act 1986, including the 2022 unfair contract terms amendments

  • the Consumer Guarantees Act 1993

  • the Privacy Act 2020, including IPP3A updates effective May 2026

2. Products & Services

We supply custom-made curtains, blinds, tracks, soft furnishings, and installation services.

Because all products are made to order:

  • fabric colours, textures, and dye batches may vary

  • small measurement variances are normal within industry tolerances

  • once materials are ordered, they cannot be returned or refunded unless required by law

If you have specific requirements (e.g., exact colour matching), please discuss these with us before confirming your order.

3. Quotes, Pricing & Variations

3.1 Quotes

Quotes are valid for 30 days unless stated otherwise. A quote may change if:

  • measurements change

  • fabric or hardware availability changes

  • supplier pricing changes before acceptance

  • the scope of work changes

3.2 Variations

Any change requested after the order is confirmed may result in additional charges and extended timeframes. Variations must be approved in writing.

3.3 Freight & Supplier Delays

We are not responsible for delays caused by suppliers, freight companies, or events outside our control. We will keep you updated if delays occur.

4. Deposits & Payment Terms

  • A 50% deposit is required to confirm all orders.

  • No materials will be ordered until the deposit is received.

  • The remaining balance is due on installation day or within 7 days after installation.

4.1 Late Payments

If payment is not made by the due date, we may charge:

  • interest at 2% per month, and

  • reasonable costs of debt recovery

We retain ownership of all goods until full payment is received.

5. Cancellations

Because products are custom-made:

  • cancellations after materials have been ordered will incur costs equal to materials purchased and work completed

  • cancellations within 24 hours of installation may incur a call‑out fee

If we must cancel or reschedule due to illness, weather, or supplier delays, we will rebook the earliest available time.

6. Installation

We take care during installation; however, we are not responsible for:

  • pre-existing issues with walls, framing, or fixtures

  • hidden wiring, plumbing, or structural defects

  • damage caused by movement or settling of the home

  • installation on surfaces that are brittle, cracked, or unstable

If additional bracketing, fixings, or remedial work is required, extra charges may apply.

7. Warranties

7.1 Product Warranties

We honour all manufacturer warranties for fabrics, tracks, and hardware.

Warranties do not cover:

  • normal wear and tear

  • fading from sunlight

  • mould or moisture damage

  • damage caused by pets, children, or misuse

  • shrinkage within industry tolerances

7.2 Workmanship Warranty

Installation workmanship is guaranteed for 12 months.

8. Compliance, Privacy & Data Protection

We comply with:

  • the Fair Trading Act 1986, including the 2022 unfair contract terms amendments

  • the Consumer Guarantees Act 1993

  • the Privacy Act 2020, including IPP3A updates effective May 2026

8.1 Information We Collect

We collect only the information needed to quote, supply, install, and communicate with you.

8.2 How We Use Your Information

Your information is used for:

  • quoting and invoicing

  • ordering materials

  • scheduling installation

  • warranty or service communication

We do not sell or share your information with third parties except suppliers directly involved in fulfilling your order.

8.3 Your Rights

You may request access to, or correction of, your personal information at any time.

9. Liability

To the extent permitted by law:

  • our liability is limited to the value of the goods or services supplied

  • we are not responsible for indirect or consequential loss

  • we are not liable for delays outside our control

Nothing in these Terms limits your rights under the Consumer Guarantees Act.

10. Dispute Resolution

If an issue arises, both parties agree to try to resolve it in good faith. If a resolution cannot be reached, the matter may be referred to mediation before legal action is taken.

11. General

  • These Terms are governed by New Zealand law.

  • If any clause is found to be invalid, the remaining clauses still apply.

  • We may update these Terms to reflect legal changes. Updated Terms apply to new orders only.

12. Dictionary (Definitions)

“Goods” – custom-made curtains, blinds, tracks, and related products. “Services” – measuring, quoting, installation, and consultation. “Order” – confirmed acceptance of a quote and payment of a deposit. “Variation” – any change to the original order. “Working Days” – Monday to Friday, excluding public holidays.

13. Acceptance of Terms

You accept these Terms when you:

  • sign a quote

  • confirm by email

  • pay a deposit

  • or otherwise instruct us to proceed
